These Terms of Service ("Terms") govern your access to and use of the EngagePOS platform and website (engageposph.com), operated by Engage Innovative Solutions ("EngagePOS", "we", "us", or "our"). By registering for or using our service, you agree to be bound by these Terms.
Please read these Terms carefully. If you do not agree, do not use our service.
By completing our registration form, making a payment, or accessing the EngagePOS platform, you confirm that:
EngagePOS is a cloud-based point-of-sale (POS) software platform designed for Philippine MSMEs, including retail stores, restaurants, laundry shops, and service businesses. The platform provides tools for sales recording, inventory management, customer records, reporting, and related business operations.
Features vary by plan (Basic, Standard, Premium). Plan-specific feature lists are available at engageposph.com/get-started.
Your account is created upon verified payment. You are responsible for:
You may not share your account credentials with third parties outside your business or use your account for purposes other than your own business operations.
Payment-first model: Access to EngagePOS is granted only after your payment is received and verified by our team. We do not offer provisional access pending payment.
Billing period: Plans are billed annually (365 days) unless otherwise stated at the time of purchase.
Accepted payment methods: Bank transfer via InstaPay (BDO, BPI, SeaBank) for Philippine customers. International customers may be subject to different arrangements communicated at the time of registration.
Verification: After transferring payment, you must upload a screenshot or PDF of your transfer confirmation. Our team typically verifies payments within a few hours during business hours.
Pricing: Current pricing is published at engageposph.com. Prices are in Philippine Pesos (PHP) for Philippine customers. We reserve the right to change pricing with at least 30 days' notice before your renewal date.
Add-ons: Optional add-ons (such as the Kiosk Setup) are billed separately as one-time payments and are non-refundable once hardware is shipped or configured.
You may cancel at any time. There are no lock-in periods, no early termination fees, and no penalties for cancellation.
To cancel, simply do not renew your plan at the end of your billing period, or contact us at hello@engagepos.com.
Refunds: Due to the nature of software services and our payment-first model, payments are generally non-refundable once your account has been activated. If you experience technical issues that prevent you from using the service, please contact our support team — we will work to resolve the issue promptly. Refund requests within 7 days of activation that are due to a failure on our part will be considered on a case-by-case basis.
Hardware add-ons (such as kiosk setups) are non-refundable once configured or shipped.
You agree not to use EngagePOS to:
We reserve the right to suspend or terminate accounts found in violation of these restrictions without refund.
You retain ownership of all business data you enter into the EngagePOS platform (sales records, inventory, customer records, etc.). We do not claim ownership of your business data.
We process your data in accordance with our Privacy Policy and the Data Privacy Act of 2012 (RA 10173).
Upon cancellation, you may request a data export within 30 days of account closure. After 30 days, data may be deleted from our systems.
We aim to maintain high availability for the EngagePOS platform. However, we do not guarantee uninterrupted service. Planned maintenance will be communicated in advance where possible.
We are not responsible for downtime caused by factors outside our control, including internet outages, hosting provider issues, or force majeure events.
To the maximum extent permitted by Philippine law, EngagePOS and its operators shall not be liable for:
Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
The EngagePOS platform, including its software, design, branding, and content, is the intellectual property of Engage Innovative Solutions. Nothing in these Terms grants you a license to copy, distribute, or create derivative works from our software or brand assets.
Your subscription grants you a limited, non-exclusive, non-transferable right to access and use the platform for your own business operations only.
These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Metro Manila, Philippines.
We may update these Terms from time to time. We will notify active customers by email at least 14 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
